Comprehensive paid sick leave policies that cover all workers are urgently needed if we are to reduce the spread of COVID-19, and be ready to respond to threats from new pathogens. 58% of countries do not have explicit provisions to ensure self-employed and gig economy workers have access to paid sick leave benefits. 27% of countries do not guarantee paid sick leave from the first day of illness, essential to encouraging workers to stay home when they are sick and prevent spread. While strong models exist across low- middle- and high-income countries, critical gaps that jeopardise health and economic security remain. Original labour and social security legislation and global information on social security systems for each country were obtained and analysed by a multilingual research team using a common coding framework. To assess whether paid sick leave is available in countries around the world, we created and analysed a database of legislative guarantees of paid leave for personal illness in 193 UN member states. Well-designed paid sick leave is critical to ensure workers stay home when sick to prevent the spread of SARS-CoV-2 and other infectious pathogens, both when the economy is open and during an economic shutdown. Finally, this article provides suggestions to improve the mechanism in protecting the employment rights at the workplace in order to maintain a harmonious relationship between employers and employees despite going through difficult times. Besides that, court cases studies are employed to reach the objective of this research. This is a qualitative research where analysis is made through secondary sources such as article journals, books, government directives, websites and government statutes. This paper examines rights of employees under the Employment Act 1955 which involves discussion on issues such as deduction of wages, leave utilisation, and retrenchment of employee in Malaysia during the COVID-19 pandemic period. As a consequence, employees are deprived of their rights at the workplace. In order to survive this pandemic, employers have taken various measures to sustain the business and unfortunately employees are deeply affected by these measures. Actions taken to curb the spread of the COVID-19 in the community such as movement restriction order by the government have given a negative impact to the nation's economy. COVID-19 has created chaos in most parts of the world.
